Catherine Myra Banich

Catherine Banich is a commercial litigator who has more than 18 years of experience across multiple practice areas. She focuses on the representation of financial institutions in the prosecution and defense of a variety of claims in federal and state courts at both the trial and appellate levels.

Representative clients include community and regional banks along with some of the largest financial institutions in the nation.

Representative actions include asset recovery against borrowers and guarantors, restructuring and workouts, regulatory compliance litigation under the Truth in Lending Act (TILA), Real Estate Settlement Procedures Act (RESPA), Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), Home Affordable Modification Program (HAMP) and related acts, mortgage fraud litigation, defense of wrongful foreclosure and eviction actions, judicial foreclosures, tax sales and related litigation, receiverships, title curative litigation, reformation and declaratory actions, contract and agency disputes, quiet title cases, equitable subrogation cases, boundary disputes, trespass, ejection and encroachment, and premises liability claims.

A significant portion of Ms. Banich’s practice also is devoted to employment litigation, with a focus on the representation of employers in claims of discrimination, harassment, retaliation, employment-related torts, employment contracts and post-employment restrictive covenants. Ms. Banich also counsels employers in employee relations, discipline and discharge matters, and assists in drafting employment policies in compliance with federal and state employment laws.
