I would agree with the lawyer in so far as filing a motion to reopen.
However if he did not attend the hearing and he had notice of the hearing...

I received notice for interview on 03/29/11 for AOS family based. After questioning, I was told that we will send the decision .

You can file for them. They will be able to obtain permanent residency status and this will override the tourist visas.

It is best to retain an immigration lawyer to assess his case and apply for a bond after he is taken into ICE custody.
