A little after midnight on August 23, 2012, Sherman Spencer collided with a Roto-Rooter van that was stopped in a travel lane of I-20 in Atlanta because it had run out of gas. Through discovery, we le...arned the Roto-Rooter employee had been driving for up to a week with a malfunctioning gas gauge. We also uncovered evidence that the Roto-Rooter employee was unlicensed when Roto-Rooter hired him. Roto-Rooter claimed Mr. Spencer had vision problems at the time of the collision and should have avoided the van. We settled the case prior to trial, and after paying Mr. Spencer's medical bills, he walked away with over $150,000.

Defendants hired Mr. Corlett, a diesel mechanic, to service logging equipment at a logging site controlled by Defendants. Defendants negligently failed to warn Mr. Corlett of the dangers presented and ...mark off a designated safe area for those, like Mr. Corlett, who were not essential to Defendants’ logging operation to ensure safety. As Mr. Corlett was servicing Defendants’ equipment, Defendants were unloading, loading, and/or moving logs into a truck in the same area as Mr. Corlett, in violation of Georgia law, OSHA regulations, and industry standards. One of Defendants’ employees was in the process of moving a log by swinging it with a machine when he negligently struck Mr. Corlett from behind in the neck/back area with the log, causing him to fall and hit his head on a tree stump. Mr. Corlett spent approximately a month in the hospital as a result of the event but eventually died from injuries sustained when struck with the log. Case settled prior to trial.
