Yes, sorry for your loss. Unfortunately, if your father wanted you to share in the life insurance he should have listed you as co-beneficiary.

I agree with the other two legal opinions. If the debt in fact exceed assets, it might be best to avoid probate.

Call Clay Porter at 800-644-2001. He's a lawyer in Savannah and a friend of mine. As magistrate courts won't handle defamation cases.

LLC hands down. Gives you legal protection without as many restrictions as a corporation and you can pick whatever taxation you want.
