A lot depends on whether he left the house to you in a will. If no will the other attys have explained the intestacy laws.

Filing may be the only way but as stated by Ms Bunce it is not clear whether or not your mother has any equity in the property.
Can a personal representative leave a beneficiary out of the inheritance without having a legal document that gives the reason?
