Children cannot change the will. Only the person making the will can change it
What state do you file a small estate affidavit in, if the deceased did not reside in the state where the family resides?

You would have to sue him to get it back and that is probably not worthwhile even in small claims court

Google company registration and then go to that site (usually Secretary of State or State corp commission) and fill out the necessary forms
