Another insurance company low-ball counter-offer defeated
Dec 21, 2020OUTCOME: Case settled for policy limits: $25,000.00
Client was t-boned at an intersection by a negligent driver. He sustained minor injuries and I got him immediate chiropractic care with no up-front charges. That led to medical doctor care and treatm ... ents, an MRI, a back brace, and physical therapy, again, at no up-front charge to the client. The total medical bills were about $20,000.00. The negligent driver had only a $25,000.00 insurance policy and I demanded the entire amount (client has an uninsured/under-insured claim remaining). The insurance adjuster counter-offered with $5,400.00. Yes, you read that correctly. I immediately filed a lawsuit. Once the other driver was served with the lawsuit, I got a call from a "senior adjuster" and they said they'd re-evaluate the case and get back to me. I told them not to waste my time with anything less than the entire policy of $25k. Two weeks later, a call came in advising me they would pay the entire policy limits ($25k). Never, never, I mean NEVER accept their low-ball offers. I reduced my attorney's fees, got all medical providers to reduce theirs, too, and wound up paying the client a decent amount of money, considering (he was very happy).
