Following an accident, the driver was charged with under 21 DUI, driving on a suspended license, underage possession of alcohol, and driving on the wrong side of the road. Lance was able to obtain a vi ... deo (with audio) that proved the officer failed to advise the driver of the Georgia implied consent notice and the .082 test result was suppressed at a motions hearing. Lance was also able to show that the "suspended license" was the result of a failure to appear that had already been corrected and the driver showed the reinstatement paper to the arresting officer. The case was offered for a plea of nolo to reckless driving and driving on the wrong side of the road. The plea was entered after the driver turned 21 and there was no license suspension associated with the plea.2014D-01835

Client was arrested at his home for suspected DUI and failure to maintain lane. He admitted to being drunk and submitted to field sobriety evaluations. He also submitted to the state-administered breat ... h test with a result of .250. The evidence would have been that the defendant was drinking at home after driving and it was likely that the test result would have been suppressed. The prosecution had a witness problem and a problem with establishing the time line (records indicated there was plenty of time between the observed driving and the officer's initial contact with the driver to become very intoxicated). The case was offered for a reduction to reckless driving prior to a hearing on the motion to suppress. 14D-02651

At trial, the judge allowed the jury to hear evidence of the prior DUI ... , which included a test result that was six times the per se limit. Our first trial resulted in a conviction for following to close and a mistrial (hung jury) on the DUI. In the second trial, the Judge allowed the jury to hear evidence of the prior DUI AND ALLOWED the prosecutor to play an audio recording of our client's testimony from the previous jury trial. The jury in our second trial deliberated for less than five minutes before returning a verdict of Not Guilty! Case No. ST-14-CR-2195

The result was a well reasoned, unanimous decision that resolves a long standing conflict between ... the statutory requirements of Georgia's implied consent law and the protections founded in the Fourth Amendment. Since 1973, Georgia officers have been authorized to compel a state-administered blood-alcohol test based upon probable cause without having to get a search warrant or show an exception to the warrant requirement. With this decision, an officer must have a search warrant or, if the officer does not have a search warrant, they must be able to show, by a totality of the circumstance, an exception to the warrant requirement. Where an officer is relying upon the consent exception to the warrant requirement, the officer may not use a suspect's mere submission under the implied consent notice (which informs DUI suspects the law requires they submit to a state-administered test) to show the suspect's actual, voluntarily consent.
