Client with CDL was arrested after driving his car into a telephone pole. He was charged with DUI Less Safe and failure to maintain lane. The arresting officer described him as falling down; unable to ... stand on his own, slurring his words to the point of being unintelligible and cursing. We were able to show the officer failed to perform even a minimal investigation to include checking to determine whether our client was DUI or simply suffering from the results of trauma due to the accident. The charges were reduced to reckless driving during pre-trial negotiations.

During pre-arraignment negotiations I was able to get the officer to withdraw the administrative "refusal" suspension and get the District Attorney to drop the DUI prior to filing the accusation. Client entered a plea to reckless driving and open container and Nolo (no contest) to the marijuana. No jail and no license suspension
