Actually, the defense has MORE right to do that than the prosecution, but even the prosecution can do that in certain situations.
In criminal trials are depositions required or just requested from the defense attorneys?

The error in the name is no defense, but there are other defenses that your friend may have that only a lawyer would recognize. Hire one.
