Client (R.B.) was charged with DUI in Hall County State Court. The State’s evidence was that Client was involved in a “head-on” collision, had a strong odor of alcohol, bloodshot, glassy eyes, slurred ... speech, that he admitted to having an open container of liquor, that he refused a breath test, and that he admitted to drinking a beer at 9 a.m. Attorney Parker McFarland hired a medical doctor who gave expert testimony that a shot of morphine at the hospital likely caused the slurred speech and that a “head-on” collision can cause symptoms associated with impairment such as bloodshot, glassy eyes, and slurred speech. The jury returned a verdict of “not guilty” to DUI.

Attorney Parker McFarland filed a personal injury civil case in Cobb County on behalf of the Clients against the driver and his trucking company and settled the case prior to trial for $245,000.00. Pointer v. State, 299 Ga. App. 249 (2009) Client (N.P.) was convicted of child molestation and sexual battery in 2002 in Lamar County Superior Court. In 2008, Client retained new counsel, Parker McFarland, to handle his appeal. Client had just begun serving a seven-year prison sentence for a probation violation when Attorney Parker McFarland filed a motion for new trial, alleging that a state expert improperly bolstered the credibility of the victim and invaded the province of the jury when he testified that his evaluation “strongly suggests that the victim had been sexually abused as alleged.” McFarland also stated that Client’s trial attorney provided ineffective assistance of counsel by failing to object, move for a mistrial, or ask for an instruction from the judge to the jury to disregard the improper testimony. The trial court denied the motion and an appeal was filed to the Georgia Court of Appeals. The Court of Appeals ruled that this testimony was improper and that trial counsel was deficient in failing to object to it. Moreover, the Court of Appeals agreed with Parker McFarland that the evidence was not overwhelming and that trial counsel’s failure to object contributed to the verdict. Therefore, the Court of Appeals reversed all convictions and granted a new trial.

McKenzie v. State, 279 Ga. 265 (2005) McKenzie was charged by the Forsyth County Solicitor’s Office with five counts of obscene telephone calls which were collect telephone calls that he made to his g ... irlfriend and which she accepted. At the bench trial, the Forsyth County State Court Judge convicted him of two counts of obscene telephone calls and he was found “not guilty” of three counts. Attorney Parker McFarland challenged the statute on First Amendment grounds and the trial judge ruled that the statute was constitutional. McFarland filed an appeal to the Georgia Supreme Court and McKenzie’s convictions were unanimously reversed. The Supreme Court ruled that the obscene telephone calls statute was unconstitutional because it violated the free speech rights guaranteed by the First Amendment of the United States Constitution. Therefore, McKenzie was exonerated of all charges.

At the jury trial, the officer testified that Client had an odor of alcohol, bloodshot eyes, that he found a case of beer in Client’s vehicle with SEVEN missing beers, and that Client admitted that he “just killed a beer.” The jury found Client “not guilty” of DUI.

Forsyth County officers detained Client (S.W.) and his codefendant who were transferring items from one vehicle to another at 1:30 a.m. in a parking lot of a building under construction. Even though Cl ... ient’s vehicle had a flat tire, four police officers were suspicious of the defendants. Officers patted down Client’s codefendant and discovered suspected methamphetamine. The officers then searched both defendants’ vehicles and discovered numerous materials commonly used to make methamphetamine. Client was charged with (1) manufacturing meth, (2) conspiring to manufacture meth, (3) conspiring to distribute meth, (4) possession of meth with intent to distribute, and (5) possession of meth. Attorney Parker McFarland filed a motion to suppress challenging the detention of Client and the search of Client’s vehicle. After a two-day hearing, the Forsyth County Superior Court judge granted the motion to suppress, finding that the pat-down and subsequent search of the vehicles was unlawful, and all the charges were dismissed.

At the jury trial in Forsyth County State Court, the officer testified that Defendan ... t admitted to taking two Lortabs 4-6 hours prior to arrest, was speeding, unsteady on his feet, failed the HGN eye test with six of six possible clues, had bloodshot, watery, and very dilated eyes, non-reacting pupils, slow speech, slow reactions, was slow in stopping, had sweaty skin, that Client failed the one-leg stand with three out of four possible clues, that Client failed the Rhomberg test by estimating 30 seconds in 40 seconds, and that Client refused a blood and urine test. Client testified that he took Lortab pursuant to a prescription resulting from back surgery. Attorney Parker McFarland argued to the jury that the State had not met its burden of proof for DUI prescription drugs, that Client was “incapable of driving safely”. The jury agreed and returned a “not guilty” verdict for both DUI Drugs and Speeding.
