May 17, 2012OUTCOME: The court of appeals affirmed the majority of the trial court's ruling, and reversed a portion of the trial court's ruling in the Youngs' favor, and awarded the Youngs their attorneys fees for the appeal.
Builder sought to force the Youngs to purchase a home for a price in excess of a million dollars when the appraisals all confirmed that the market value was approximately $200,000 less than that price. ... The court of appeals affirmed the trial court's ruling reached after a bench trial that there was not an express contract between the parties. The court of appeals further concluded that there were no equitable theories that were applicable. The court of appeals awarded the Youngs their attorneys fees for the appeal in addition to the attorneys fees previously awarded to the Youngs by the trial court.
