Boating Under the Influence

Gentleman was stopped by SC DNR Officer for a boat safety check. Driver had been at a festival all day and was suspected of driving a boat under the influence of alcohol. Field sobriety tests were admi ... nistered on the boat by the officer and he stated that the driver failed and was placed under arrest. Driver refused to take the breathalyzer administered by SLED and was taken to jail. After discovery requests were made and arguments we made the officer decided to dismiss the case outright.
