Client allegedly committed several new possession of narcotics and firearms and ammo felonies while out on bail facing a felony 422 charge. Client could not get any offer less than 6 years after sever ... al pre-trial conferences with his former attorney. I took the case and it turned out that all the client needed was an opportunity to be heard. Sat down with the DA on my second pre-trial conference and laid out each motion I had good cause to run in each of the 3 felony cases. 30 minutes later, new offer and 1 happy client.

OUTCOME: wet and reckless in court/DMV hearing won: no license suspension.

Client had a clear rising pattern in her breath tests with mediocre performance on her field sobriety tests. After investigating whether or not it was a blinking red light or yellow with the Sacrament ... o City Engineer's Office, the stop was legal. Problem was that this was client's second DUI in the eyes of the court and her third in the eyes of the DMV. Her biggest concern was her license due to job concerns. Client did not want to risk it at trial and resolved for a wet and reckless in court. Requested the calibration logs after a discussion with a colleague and discovered a third number that gave further credence to the rising blood alcohol level defense and paid for a toxicology expert. DMV HEARING WON.
