Attorneys, Brian Breiter and Jeffrey Twomey tried the case for 2 1/2 weeks in Santa Monica, in front of Judge Michael Levanas and a jury of 12 plus two alternates. The accident happened December 20, 2018 in Los Angeles when a driver logged into the Uber app struck the plaintiff in the crosswalk while he was out for a run. The plaintiff was taken by ambulance to Cedar Sinai Hospital where he was diagnosed with a broken collarbone and a concussion. For the past 5 1/2 years, Uber and the driver had denied liability for the accident. On the first day of trial, Uber admitted to vicarious liability and that the driver was negligent in causing the collision. Uber, through their defense, made it clear that they were not going to settle this case and wanted a jury to determine the outcome. The case was so difficult because of the complicated medical testimony regarding the plaintiff’s pre-accident condition called femoral acetabular impingement (FAI). “This was an important case because now Uber would finally be held fully accountable for the negligent acts of drivers logged into their app. This was not a trial where Uber got to set the rate of the damages, that was left to the humans on the jury. They got it right and Uber gambled with the wrong plaintiff.” said Brian Breiter, co-lead trial counsel for the Plaintiff.
