Ms. Carder represented the insurance company and won summary judgment, resulting in dismissal in its entirety of this procedurally and substantively complex case.

After the insurer denied coverage, Rubio’s filed suit alleging the denial was in bad faith. Ms. Carder successfully briefed and argued the motion for partial summary judgment and obtained dismissal of the bad faith and punitive damages claims.

Ms. Carder successfully briefed and argued the coverage issue before the district court which granted summary judgment on the coverage issue. She then argued the matter before the Ninth Circuit Court of Appeals, which affirmed the district court’s dismissal of plaintiff’s bad faith and punitive damages claims.
