OUTCOME: Court reversed PDC's fine against Plaintiff

This was a pro bono case I handled which dealt with Washington's false political advertising statute. The PDC fined (under Washington false political advertising statute) the plaintiff for allegedly m ... aking a false campaign statement about an opponent. I (as a cooperating attorney for the ACLU) represented Ms. Rickert from the administrative level through her appeal to the Washington Supreme Court. The Washington Supreme Court found that the statute infringed on the First Amendment rights of candidates and reversed the fine (and struck down the statute).

OUTCOME: Court reversed court of appeals decision.

This case involved application of the minimum contacts analysis to emails that were transmitted from outside Utah to a Utah residents. Plaintiffs sued Defendant alleging violations of Utah's email sta ... tute. The trial court found no personal jurisdiction based on the minimal contacts. The Utah Court of Appeals held that even a single email transmitted into the forum state was sufficient for jurisdiction. The Utah Supreme Court reversed, finding that the assertion of jurisdiction was not appropriate.
