The Court of Appeal u ... pheld the City's certification of the ERI and found that: (1) EIR did not engage in improper piecemeal review in excluding pending residential and commercial development from the project definition; (2) EIR adequately analyzed cumulative traffic impact; (3) evidence supported finding that the project would not have growth-inducing impact; (4) evidence supported finding that mitigation would reduce impact on threatened bird to less than significant level; and (5) EIR adequately analyzed consistency with California Coastal Act.
