I represented an Executor in a Probate where the decedent and three children were killed by the husband. The husband subsequently committed suicide. There was a large life insurance policy. The husban ... d was the insured. The insurance company wanted to pay the proceeds to the killer's estate since he was an insured and when he died there was no beneficiary living. The Insurance company said the contract stated that in this case the policy should pay out to the estate of the insured. In this case that was the killer's estate. When the insured died no beneficiary was living. I came up with a legal and equitable solution get a probate court order to have the life insurance proceeds paid to the estate of the victim.
