Very poor representation in appeal hearing and no cmpassion for issue.
My experience with this attorney Moinca Wilson, is that she is completely unprofessional and lacks the knowledge and compassion to be performing such a crucial role. Currently, I “do not” know if a decision was made in my favor or not in my unemployment appeal however, I can say is my experience wit...h this attorney was simply awful.
During my hearing the employer “did not show” and I had several articles of evidence that should make the hearing case a slam dunk. Monica Wilson was very aware of each of these articles as we discussed them in a hearing prep in which I thought she was making case notes. During the hearing she ask three questions total one of which stated "did your contract state you would be paid overtime". This questioned showed that she did not review my case as the contracted states "you will be compensated for time worked" not overtime. This was issue enough that the hearing officer followed back up on it and made note that it did not say overtime. Monica’s lack of knowledge and lack of questions, I felt, only hurt my case. The questions she asked me were simply questions that the hearing officer had already asked prior. She never asked questions that I felt were key and that showed that the employer had an on going history of this same complaint. An example would be questions that pertained to the current “class action by over 200 employees stating the same issue with the employer “ this is also evidence that she had along with the hearing officer in their possession during the hearing. Unfortunately, as the claimant in the hearing, I was unable to answer almost anything other than “yes” or “no” answer which prevented me from mentioning or adding on to important issues. As my attorney, I expected I could rely on Monica to clarify those details. Monica gave a very simple approximately 1 minute closing argument that I truly believe provided no substance to the case.
After the hearing Monica did not even have the courtesy to follow up with a debriefing by phone or email so I sent her an email and after emailing her several times, I finally received a response that was open ended and no help at all. I contacted her by phone and was told that I have asked her to many questions to stop and calm down. Not once did I raise my voice or come close to having an attitude that was as unprofessional as hers. I did instruct Monica that I thanked her for her time and that she will not be personally contacted by myself again and I disconnected the call. 30 minutes later, I contacted the Monica office 919-572-2900 again and I requested that I would like to speak with someone other than Monica about a refund. Not surprisingly I was hung up on. I truly cannot believe the way I have been treated or the service I was provided.
I think it is improtant to note Just this month she has had the same basic complaint with BBB “Very poor representation in appeal hearing”. Read the response made and determine for yourself if this attorney is right for your and your unemployment hearing.
