Plaintiff John Linstrum was driving his vehicle northbound on State Route 1 in San Luis Obispo at the intersection with Dairy Creek Road/Hollister Avenue. Mr. Linstrum approached the intersection at S ... tate Route 1 & Hollister and came to a complete stop in the left turn pocket. He had a red light. Also at that time, defendant Mr. Macri, while in the course and scope of his employment with defendant, Boneso Brothers Construction, was traveling southbound on State Route 1 approaching the intersection. Mr. Macri was on his way to a job. The light turned green for plaintiff John Linstrum and he commenced turning left. At that same moment, Anthony Macri proceeded to enter the intersection from the other side of the intersection on a red light. Anthony Macri failed to yield and his vehicle and plaintiff’s vehicle impacted defendant’s vehicle. As a result of the accident, John Linstrum suffered injuries. Plaintiff thereafter filed this action based upon the negligence of defendants. Matter resolved on 3rd day of trial.

Decedent Manuel A. Gonzalez, Jr. 43 years of age, was a correctional peace officer of the state prison China for 16 years. On Jan. 10, 2005 Gonzalez was allegedly stabbed by inmate Jon Christopher Blal ... ock in the reception area of the prison, where inmates awaiting transfers to other prisons are housed. Gonzalez, who at the time was routinely distributed sack lunches, was married to Sylvia Gonzalez and together had six children. He was not wearing a protective vest at the time. Blaylock was serving a sentence for 75 years for attempted murder of a peace officer. He had a history of mental health problems and had previously assaulted prison staff and other prisoners. The Gonzalez family filed a 100 million lawsuit in U.S. District Court Los Angeles naming former Corrections Secretary Roderick Q. Hickman, former Chino Warden Lori DiCarlo and former State Corrections Secretary Jeanne Woodford. Gonzalez’ family claims the prison system administrators contributed to Gonzalez’ death because they failed to issue Manuel a stabproof vest and instead stored them in a warehouse. This contention was later dismissed by the court. The family also claimed the prison system administrators failed to properly house Blaylock. DiCarlo had written to state officials pleading to have Blaylock transferred to a higher-security prison in Vacaville. This is the first case of an on-duty guard being killed in a California prison for two decades.
