Dad filed for a temporary restraining order 5 months after an incident happened wherein his girlfriend tried to make my client leave the house where Dad and girlfriend were living whe ... n Mom went there to pick up their son. The judge denied the restraining order, stating that 1) Dad waited too long to file the TRO, 2) Dad can't obtain a restraining order on behalf of the girlfriend, and 3) it appeared that Dad was only doing this to get a "leg up" in the proceedings because he also filed a request for more visitation.
Removal of Encumbrances from Property

My client purchase business property from a receiver who was appointed to sell the property during a particularly nasty divorce. The parties to the divorce were ordered not to do anything to encumber ... the property while it was being sold. After my client purchased the property, the wife place 4 encumbrances on the property: Quitclaim deed, Deed of Trust, Lis Pendens, and Lease, all recorded at the county recorder's office. Because no one was doing anything to remove those encumbrances, I filed a Motion to Intervene on behalf of my client, which was granted, and then filed a Complaint in Intervention. Immediately after that, because the party who was supposed to be paying the mortgage stopped, causing the property to go into default, I filed a Request for Order asking the court to remove all the encumbrances. On the day of the hearing, the request was granted.
