Comstock v. Comstock
Nov 17, 2015OUTCOME: DVPO renewal upheld on appeal
Co-wrote Amicus brief on behalf of the Plaintiff that was submitted to the NC Court of Appeals. Domestic violence victim obtained a protective order in NC, where both parties lived. She then moved out ... of state. She filed a motion to renew the order before it expired, and the trial court granted the renewal. The Defendant appealed, arguing that the Plaintiff could not renew the order in NC because she no longer lived in NC. In a case of first impression, the Court of Appeals ruled that the Plaintiff does not have to live in NC to apply for a renewal of a domestic violence protective order, as long as the Plaintiff was in NC when the order was initially entered.
