Wife was in the middle of a divorce proceeding when husband passed away. Court had already entered a judgment of dissolution with determination of community property reserved. Petitioned on behalf of ... wife to be appointed as surviving spouse. Successfully argued that divorce judgment did not prevent wife from being treated as surviving spouse for purposes of probate (because of reserved property issues). Client was appointed as personal representative and received bulk of the estate through family support, personal representative fees and spousal share.
