OUTCOME: The judge dismissed the DWI charge against my client.

My client was charged with DWI, even after my client's highest Blood Alcohol Concentration results were only .08. The State proceeded on the theory of retrograde extrapolation and had an expert from th ... e State Bureau of Investigation admitted as an expert to testify at the hearing about this theory and its application to my client's case. In my cross examination of the expert, I raised several concerns generally about the statistical validity of the expert's research supporting the expert's theory and some specific concerns about applying that theory to my client's case.
