The Washington State Supreme Court unanimously agreed the City of Bothell violated my client's constitutional right to jury trial, granting him a new trial.
OUTCOME: The Court unanimously overturned both the Bothell Court and the King County Superior Court on direct appeal.

OUTCOME: The Washington State Supreme Court unanimously ruled my client was denied a fair trial because the Judge refused to instruct the jury that a defendant who claims self-defense has "no duty to retreat" from an aggressor.
Appeal of a felony Second Degree Assault conviction. My client was asserting a claim of Self-Defense when a young man from his sister's high school confronted him about rumors he had heard Mr. Redmond ... had been spreading. Mr. Redmond (18 or 19 years old at the time), testified the "victim" confronted him aggressively, and he believed he was in imminent danger. The judge made several errors allowing hearsay about the defendant's penchant for violence at trial, in effect denying Mr. Redmond a fair trial. The judge also refused to properly instruct the jury Mr. Redmond had "no duty to retreat" from the confrontation. Because of stiff sentence mandates for crimes committed with guns in Washington, he face ... d over 15 years in prison if convicted at trial. 20 yr. old in the Navy charged with First Degree Assault of a Child when he accidentally broke his 5 month old baby's arm when he awoke suddenly and picked her up by her arm.
