The Superior Court of Cochise County, Arizona, granted judgment in favor of Plaintiffs, buyer and partner, on the slander of title and breach of contract claims. The trial court awarded attorney fees, ... sanctions, and costs to the buyer and partner. Defendant appealed. OVERVIEW: The appellate court found that the seller did not show that the buyer violated Ariz. Rev. Stat. § 33-420. It did not show appellees violated § 33-420(C) by failing to release the interest. As such, the seller was not entitled to damages. The trial court did not err by finding the seller in breach of the contract for failing to return the earnest money. The seller brought claims on several tort theories in addition to its claim for breach of contract. These types of claims had been found not to arise "out of a contract," Ariz. Rev. Stat. § 12-341.01(A). Although the findings of fact and conclusions of law upon which the trial court relied in awarding the fees were sufficient to meet the requirements of Ariz. Rev. Stat. §§ 12-341.01(C) and 12-349(A), they pertained to discrete issues which were not central to the basic breach of contract and tort contests. The award of sanctions was proper. The trial court had to recalculate taxable costs, including the double taxable costs awarded as a sanction.
