OUTCOME: The parties mediated the case and settled for $25,000. Non-confidentiality was a specifically bargained for part of the settlement.
Gold Value sued our clients for alleged infringement of 3 fabric designs, demanding disgorgement of profits, damages fore willful infringement, and attorney's fees. Gold Value had sued these same clien...ts for one of these designs 3 years ago, and that claim had been dismissed with prejudice. The other two designs had not been registered for copyrights properly; Gold Value's copyright application claimed the designs were unpublished, when in fact Gold Value had sold samples of the fabric designs before applying for the copyrights. That meant that they copyright registrations were invalid and could not support a claim for infringement.
