I recently had a client receive a Discharge Order in a Chapter 7 Bankruptcy. The Order states that all of her debt is wiped out. She was highly stressed about her financial circumstances when we fir ... st met. She was receiving constant calls from creditors and one creditor had filed a lawsuit against her. She qualified for the filing of a Chapter 7 Bankruptcy. Once we filed the Chapter 7 Bankruptcy, the lawsuit against her was stopped and she stopped receiving creditor calls. Within a period of approximately six months, she met with me, filing a bankruptcy and received a Discharge Order stating that her debts are wiped out. She is not able to move forward in her life without concerns about creditor collections.

I recently had a client complete his Chapter 13 Plan payments and receive an Order from the Judge that his debts are wiped out. His payments were based on his income and expenses and his assets, not t ... he amount he owed. His payments were approximately $125.00 per month. The client was very pleased that his payment was manageable. He felt that the experience was not stressful. He is very happy to have completed his plan and received the Order that his debts are wiped out. He can now move forward in his life without the debt to weigh him down.

Wiping out Second Mortgage in Bankruptcy

OUTCOME: Second Mortgage Wiped Out

I filed a Chapter 13 Bankruptcy for a married couple. The couple owned a home worth approximately $350,000. They had a first mortgage on the home with a balance owed of approximately $400,000. There ... was a second mortgage on the home with a balance of approximately $65,000. After I filed the Chapter 13 Bankruptcy, I filed a Motion to Value the Real Property and to determine that the second mortgage should be wiped out as unsecured debt. I won on the motion! So, the married couple was able to remain in their home and continued making mortgage payments on their first mortgage. They no longer had to make mortgage payments on the second mortgage. They are making payments under the Chapter 13 Plan of approximately $200 per month. This is based on their income, expenses and assets. Once they are finished with all of their plan payments, the will receive an Order stating that all of their debts (credit card debt) is wiped out, and that their second mortgage is wiped out as well.
