Geraldine Ly of Real, Hernandez & Ly settled a workers’ compensation matter for $285,000 plus a $10,000 vocational voucher for her client who suffered an amputation to her pinky. The client worked ... for a publication production company as a binding operator. Her finger was pulled violently into the defective strapping machine, causing it to be wedged and severed between the sprocket and chain. While there is no recovery for emotional distress or general damages in workers’ compensation claims, Geraldine included severe psychological trauma as part of her claim and was able to obtain compensation for emotional damages and humiliation as a “quantifiable” component.

Geraldine Ly of Real Hernandez & Ly, LLP procured a $1,173,000 workers’ compensation settlement for her client who suffered a broken ankle which eventually led to stage-3 complex regional pain synd ... rome (CRPS) in her left leg. Her client was formerly represented by two other attorneys who told the client to take $10,000 and $15,000, respectively, as total settlement for the case. Geraldine assumed the case and sued the Agreed Medical Examiner (AME) doctor for malpractice for failure to diagnose CRPS. That suit caused the AME to be recused from the workers’ compensation matter. A new AME was selected whose report—together with an extensive life-care plan—alerted the insurance company to take a closer look at the injury. After months of negotiations, the matter was resolved in a lump sum. Geraldine’s client structured a significant portion of her settlement for her future medical care.
