Geraldine Ly of Real, Hernandez & Ly settled a workers’ compensation matter for $285,000 plus a $10,000 vocational voucher for her client who suffered an amputation to her pinky. The client worked ... for a publication production company as a binding operator. Her finger was pulled violently into the defective strapping machine, causing it to be wedged and severed between the sprocket and chain. While there is no recovery for emotional distress or general damages in workers’ compensation claims, Geraldine included severe psychological trauma as part of her claim and was able to obtain compensation for emotional damages and humiliation as a “quantifiable” component.
