In re Majer v. Hunt (representing Respondent)
Aug 27, 2003OUTCOME: Dismissed with Sanctions payable by Appellant & his attorneys to Respondent and Court
Not Officially Published (Cal. Rules of Court, Rules 8.1105 and 8.1110, 8.1115) Christopher Majer appeals from a trial court order imposing a $3,195.50 sanction against him for refusing to provide ... discovery. Because the order is not appealable, we dismiss the appeal. Because the appeal is frivolous, we also impose sanctions. The appeal is frivolous: both section 904.1 and recent case law from this district establish clearly that the order from which an appeal was taken was unappealable. In addition, circumstantial evidence submitted by Hunt suggests that the appeal was taken for the purpose of delaying payment by Majer to Hunt and forcing Hunt to pay to defend an appeal.
