Judge Richard Eadie of the King County Superior Court issued a verdict against American Seafoods for in excess of $300,000 for a knee injury to a fish processor. The processor was working on the dock i ... n Dutch Harbor, Alaska when a heavy box of fish product fell off the offload conveyor belt and struck her knee. The court found that American Seafoods conveyor system was unseaworthy and that defendant was negligent because it was aware that boxes fell off at the transition point between its decline conveyor and dock conveyor and took no action to correct the problem or move workers out of the danger zone. The injured worker ultimately had a total knee replacement and was unable to return to American Seafoods as a processor. The Court further found that American Seafoods had engaged in willful and persistent denial of maintenance and cure benefits, and awarded damages and attorneys' fees to the injured processor.
