After prevailiing at trial and securing a judgment that the defendant was enjoined from repeating defamatory statements against our client, the trial judgment was reversed as an unlawful prior restrain ... t on speach in violation of the U.S. Consititutuion. Mr. Russo ultimately prevailed at the Supreme Court, defeating Consitutional Scholor Erwin Chemerinsky, in establishing that the trial court has the authority to enjoin defamatory speech after trial. This ruling overcame 200 years of precedent and established the injunctiive relief remedy now accepted throughout the United States.
