I represented Melissa Scott in a suit against Bremerton, Washington police officer William B. Cook and the City of Bremerton on a civil rights violation, 42 U.S.C. 1983, theory claiming that Office Coo...k used excessive force when he arrested Scott on March 23, 2003 after she called police in response to an ongoing dispute with a neighbor who was alleged to have mixed their garbage with Scott's garbage, thus leaving Scott to pay for curbside waste disposal service. Cook went to the call but determined the two tenants shared a landlord and should work the problem out themselves. Scott placed some of her trash in her neighbor's yard and refused to remove it. Scott, who weighed about 400 pounds at the time of the arrest, was placed in the back of a patrol car with handcuffs that she claimed were too tight for her wrists, which resulted in injuries to her wrists. Cook also allegedly refused to allow Scott, an asthmatic, to bring an inhaler along, which resulted in her becoming sick in the back seat. She also claimed that an attempt to remove her from the car by pulling her hair. When that failed, Cook drove her to the Kitsap County jail with the radio cranked up and braked often and hard so that Scott was "bouncing around like a pinball."
