OUTCOME: Settled favorably for client shortly after filing lawsuit

My client was employed at a restaurant, and was misclassified as salary exempt, meaning he was not entitled to receive overtime pay. Based on his job duties, he really should have been classified as n ... on-exempt, meaning he was eligible for overtime pay. We filed suit against the restaurant for all the earned but unpaid overtime wages do the misclassification and resolved the case for our client within 3 months of filing the lawsuit.

OUTCOME: Suit was filed, and the case was settled for a confidential amount shortly after being filed.

Plaintiff was a commissioned employee. When he left the company, he was not paid all his commissions that were outstanding. The company's position was since the commissions were not yet paid to the c ... ompany, Plaintiff forfeited those commissions by leaving the company. Plaintiff had also signed an agreement to that effect. However, despite that agreement, California law dictates that such an agreement is potentially unconscionable. As a result, those commissions, when received by the company, need to also be paid to the Plaintiff, even if Plaintiff no longer works for the company.
