Gross v. State, 380 S.W.3d 181 (Tex.Crim.App. 2012)
Oct 10, 2012OUTCOME: Affirmed judgment of court of appeals. Appellant was released from prison.
Attorney represented Appellant on his appeal. Appellant was convicted of murder and sentenced to 10 years in prison. Finding the evidence insufficient to support Appellant's conviction for murder under ... the "law of parties," the 14th Court of Appeals reversed the judgment of the trial court and entered a judgment of acquittal. The State filed a petition for discretionary review arguing the court of appeals erred. Upon review, the Court of Criminal Appeals concluded the appellate court properly determined that the evidence presented was insufficient to support his conviction for murder.
