On July 6, 2007, Plaintiff Ida Leivo, 44, was driving in San Dimas with her mother, plaintiff's decedent, Elida Sandoval, 73, and two children, Shawn, 10, and Danielle, 12, when the vehicle was rear-e ... nded by a truck operated by Bryant Avila. Elida Sandoval subsequently died. At trial the defense stipulated to liability for the collision. The only issue to be determined by the jury was as to damages. Ida Leivo sustained internal injuries and a traumatic brain injury. Her husband brought a loss of consortium claim. She is likely to be confined to a wheelchair for the rest of her life. Shawn sustained a fractured pelvis and Danielle sustained a fractured wrist. Neither child required surgery.
