I was appointed to represent the Defendant in the Circuit Court of Montgomery County, Virginia. Defendant had been offered a deferred disposition -- if he successfully completed VASAP, the case would ... be dismissed after one year. The client declined that offer. At trial, the Commonwealth called the necessary witnesses to establish that the police validly stopped my client and searched his vehicle, and that my client had in his possession two prescription bottles containing amphetamine (adderall). The first was labeled with his girlfriend's name, and was located in the center console. The second was unabeled and contained in the clients backpack. We called as witnessed the Defendant and his girlfriend. The Defendant testified that he had no specific recollection of possessing that pill, but he probably put it in his backpack in the event his girlfriend ever forgot her medication. He testified he used to have a prescription for Adderall, but discontinued its use because of a heart condition he was diagnosed with. The girlfriend testified that she and Defendant had been together 10 years, and she had been prescribed Adderall that entire time. She testified that Defendant usually picked her prescription up on her behalf because it was more convenient for him, and that she had completed the necessary paperwork at the pharmacy for him to be able to do so. Following twenty minutes of deliberation, the jury returned a unanimous verdict of not guilty.
