Post Judgment modification of child custody. My client, Mr. L got a DUI with the kids in the car back from a family BBQ. He jumped through every hoop presented and even more. First offense and regre...tting it. Restricted license made it so he couldn't see the kids as much for a while. I continued the matter until his license was freed and had him reinstate his old timesharing schedule. It took some phone coaching at the pick ups but by the time we returned to court, Father and kids were back to enjoying their time together. No change in dad's equal timeshare!

I represented the mother of an elementary school aged child. She had primary custody however, the Father filed a Request for Order for full custody. The Court ordered a full child custody investigati...on. The investigator recommended primary custody to father who lived in AZ. I made some strong recommendations and changes to her life including that she make peace in her home and leave her new husband (too much fighting, police called out etc.) and recommended that she make sure that she does not appear to be a "gate-keeper" to the court. I moved the case hearing date a couple times to give her time to accomplish this and she did! After a while, and some good coparenting, father finally dropped the case.

I represented a mom. Unfortunately, her ex-husband has been abusing prescription drugs - they are hoping to do an intervention but in the meantime we needed to limit dad's contact with the child. Day... one of testimony, dad presented pretty well. On day two of testimony dad finally showed as weak, disoriented and unhealthy. Father's time limited, No overnights, no driving with the child and other restrictions.

Well, after testimony from the parties and cross-examination, the Judge dismissed the other party...'s Request for Order and told the man and his counsel that he better take whatever Ms. Posey is offering because he's denying their motion for custody modification. Ouch!

OUTCOME: Success! No more spousal support!
Short term marriage about 4 years. I told my client, Mr. L to pay a certain amount as temporary/voluntary spousal support. Wife eventually filed a Request for Order for temporary support but it got c...ontinued multiple times. Finally the court set a Trial date and I had the temporary support issue continued to the Trial date. I had Mr. L pay the temporary support for about half the length of marriage and then about six months before Trial, I told him to stop. At Trial, the court agreed with my assessment of proper support in this short term marriage and declined to give wife any more spousal support and declined to make a retroactive order for support too.

OUTCOME: Primary parent retained her role
I represented Ms. O, mother of 2 school age children. Following separation, Mr. O, (father) filed a Request for Order asking for 50/50 custody of the children. Father contended that he was the primar...y caretaker while Mother worked long hours as a veterinarian.
On the stand, Father stated when he asked Mother for additional time with the children (over the regular schedule) that she would tell him "unequivocally, no." I enjoyed making him admit that he had them in his care for July 4th, 3 extra days in August, and on another occasion mother gave the children money to take dad out for a special occasion. All additional days at mother's suggestion. I cross-examined him on the fact that he missed the Science Fair, had only helped with homework a handful of times, and missed dental appointments and taekwondo too.
The Court allowed Mr. O alternate weekends from Saturday morning to Sunday night and Wednesday for dinner. No mid-week overnight.
MATTER WENT TO TRIAL 8 months later. Mr. O got a new attorney and we were assigned a new Judge and after I cross-examined him for 40 minutes, the court made a ruling DENYING his requests for shared custody - and my client didn't even have to testify!
4 months later.... Review hearing for dad to try to change the returns on Sunday night overnight to school Monday morning. DENIED.
