Eric Joseph Livingston

We hired Eric on the recommendation of someone who has seen him in action in the courtroom. While I cannot speak to how he is when defending a case, his lack of communication and unresponsiveness was so overwhelming ahead of the hearing that we had minimal confidence in his ability to appropriately r...epresent us. We hired Eric for a "Following Too Close" traffic citation which is a minor traffic infraction, but we had a highly complicated case (we were rear-ended and our car was demolished which led to a multivehicular accident and we had extensive injuries and hospitalizations). Leading up to, and especially during the week of our hearing, we called Eric's office several times asking to speak to him to review our case/defense but we never heard from him. For reasons unbeknownst to us, the crash report for our accident was not released in the almost three months between our accident and the hearing. However, we were told by Eric's admin asst that he would still be able to defend us. How he could defend our case without even seeing the accusation(s) is still something I struggle to believe. The day before our hearing we still didn't have the crash report and were told that his office would request it. Why it wasn't requested before then, I have no idea. Ultimately, my husband I were able to retrieve the report the afternoon before our hearing and we immediately sent it to Eric, still requesting consultation. We received no response until after 9:00 p.m. saying he would request a continuance now that he had "such good new information." It then took at least two weeks for his office to share our new court date. Ultimately, the experience with Eric (or lack thereof) caused so much anxiety that we did everything possible to retain alternative representation because if he was unwilling or unable to communicate his defense strategy ahead of our hearing after several attempts to contact him via text, phone, and email, then we are unwilling to put blind faith in his ability to get us the justice we deserve.
