The dog alerted on the vehicle and offic ... ers searched the vehicle and found nothing. The officers then searched the driver and the other passengers and found nothing. The officers finally searched the Defendant and recovered a couple of syringes with heroin residue. Defendant was charged with possession of heroin. Prior to trial we moved to suppress the evidence as fruit of an illegal search. The judge denied that motion and the defendant was found guilty. We appealed to the Court of appeals, who affirmed the conviction. We then appealed to the Virginia Supreme Court who reversed the decision and dismissed the charge finding that the search was in violation of the Defendant's rights against unreasonable search and seizure under the 4th Amendment to the United States Constitution.
