The refusal to take a breath test charge carried six months jail and a mandatory 3 year license revocation. The DUI carried a mandatory 20 days jail and 3 year license suspension. At trial, the refusal was dismissed and the DUI was reduced to a first offense which does not carry mandatory jail time and allows for a restricted permit to drive to and from work and for several other reasons.

The judge wanted the warrant amended before he would accept agreement (correctly noting - in my opinion - that reckless is not a lessor included offense of DUI). Officer felt he couldn't amend the warrant because of office policy, so case went to trial. Dismissed on the merits.
