U.S. v. Huckaby
Feb 08, 1990OUTCOME: Found Not Guilty of Violation of the UCMJ, Article 134, but found Guilty of Violation of the UCMJ, Article 128. LT R.J. Hatley, JAGC, USNR, appealed the conviction to the Convening Authority and, on 23 May 1990, secured a dismissal of the charges.
SSGT Huckaby was charged with the following violations of the UCMJ, to wit: (1) Violation of the UCMJ, Article 128, In that Staff Sergeant Huckaby, U.S. Marine Corps, on active duty, Headquarters Elem ... ent, Marine Corps Security Force Battalion, Pacific, did, at Mare Island Naval Shipyard, Vallejo, California, or or about 22 August 1989, assault Richard J. Santerre, who then was and was then known by Staff Sergeant Huckaby to be a person then having and in the execution of military law enforcement duties, by hitting him with his vehicle and knocking him to the pavement; (2) Violation of the UCMJ, Article 134, In that Staff Sergeant Huckaby, U.S. Marine Corps, on active duty, Headquarters Element, Marine Corps Security Force Battalion, Pacific, the driver of a vehicle at the time of an accident in which said vehicle was involved, and having knowledge of said accident, did, at Mare Island Naval Shipyard, on or about 22 August 1989, wrongfully leave the scene of the accident without making his identity known.
