Plaintiff sued for an alleged fraud in connection with a purported agreement to develop and operate hotel properties. Defendant propounded extensive written discovery, including interrogatories and ... document requests, and took plaintiffs' depositions. After plaintiff failed to provide proper responses to defendant's written discovery, or proper answers in deposition, defendant made motions to compel that were granted by the court. Defedndant failed to comply with the court orders, and defendant made a motion for terminating sanctions. Defendant's motion for terminating sanctions was granted, and the entire matter was dismissed, with prejudice. This order was then affirmed on appeal. As a result of these rulings, plaintiff's case was dismissed without a trial.
