Plaintiff was driving a truck pulling a trailer when he struck the defendant’s tractor pulling a sprayer. The farm tractor was equipped with rear-facing orange lights that were capable of being activat ... ed in a flashing mode to warn approaching motorists of a slow-moving vehicle but were off. The sprayer being towed was not equipped with any lights and was missing a rear facing reflective triangle which is mandated by the vehicle code to warn approaching motorists of a slow-moving vehicle. The defendant was unlicensed at the time and never should have been permitted to drive the subject tractor on a public roadway. As a result of the collision, the plaintiff underwent knee surgeries, suffered permanent nerve damage, a lacerated spleen, rib fractures, and more injuries.
