Raceway Ford Cases; California Supreme Court case no S222211
Dec 15, 2016OUTCOME: Affirmed in Part and Reversed in Part, in favor of Defendant Raceway Ford
Consumer class action by four plaintiff classes (approximately 1,100 and 42 members, respectively) with 21 class representatives asserting 15 causes of action, mostly stemming from backdated re-written ... vehicle purchase contracts. Plaintiffs were represented by Hal Rosner and Hawk Barry, Raceway Ford was represented by Kellie Christianson. The California Supreme Court upheld the trial court's liability findings, reversed the Fourth District Court of Appeal's direction to remand for further proceedings, and concluded that Raceway Ford did not violate the Auto Sales Finance Act by backdating purchase contracts. The Court also overturned Nelson v. Pearson Ford (2010) 186 Cal. App. 983.
