This was a birth injury case in which the baby suffered a severe, but preventable, lack of oxygen while the child's mother was supposed to be monitored by the nursing staff. The hospital had previousl ... y determined that the nurse had limited ability to recognize the signs of obstetrical emergencies, but the hospital had promoted her to charge nurse anyway. She did not understand that the baby was suffering from lack of oxygen and failed to call the doctor to come to the hospital in time to save the baby. The baby suffered a devastating brain injury and suffers from severe spastic quadriplegia, a form of cerebral palsy.
