State v. Confidential
Jan 01, 0001OUTCOME: Acquittal
The last three DUI cases I've taken to trial I have won. All three were in King County. One of them had a breath test well over the legal limit, but I successfully argued that given the trooper's rela ... tive lack of experience that the test result was not a reliable indicator of my client's level of intoxication, and the jury acquitted him. Another one involved no breath test, but was based on the trooper's observations as to my client's driving, his appearance, and his demeanor. I successfully argued that the evidence presented against my client had potentially innocent explanations unrelated to intoxication, and the jury acquitted him. The third one involved a blood draw after a dramatic crash (in which nobody was injured, fortunately!), and I got the blood draw results suppressed prior to trial, and so the jury only heard testimony from the civilian witnesses at the scene as well as the trooper's own observations of my client's appearance and demeanor. I successfully argued that the observations of all of the witnesses had potentially innocent explanations unrelated to intoxication, and the jury acquitted her.
