It is unclear what is your status. Are you US citizen ? Or are you trying to get DACA benefits for your husband? Did he go to school in the U S.?...

If you and the father were never married then you have full custody if the court decided otherwise . Do protect your child!

She can get H-1B work visa if she is qualified. But I -130 by far is the easiest rout . She might change her mind down the road anyway. Good luck!
