In Alexandria, a local resident called the police after witnessing a physical altercation at a dice game and hearing a gunshot. Investigation revealed that one party attempted to attack another party w ... ith a knife, who then drew a weapon and fired a warning shot in the air. The victim of the "shooting" was not harmed in any way. Despite the conflicting testimony of witnesses and lack of evidence, including an uncooperative "victim," the police arrested and charged a young man, M.S., with attempted malicious wounding. Investigation into this case was intensive and Harris & Carmichael vigorously asserted M.S.'s rights and challenged the government's charges. In the end, the Commonwealth DISMISSED the case of attempted malicious wounding, thereby allowing M.S. to avoid a violent felony conviction on his record without the expense and effort of going to trial.
